First Nations, cities supports B.C.’s plan to require pipeline operators to hold permits

On March 18- 22, 2019, the BC Court of Appeal heard a reference case to determine the constitutional validity, applicability and operability of proposed amendments to the Environmental Management Act that would provide for a permitting system for companies transporting hazardous substances through British Columbia, including heavy oil. The City of Burnaby represented by Michelle Bradley of Ratcliff & Company LLP argued in support of the proposed amendments that governments closest to communities should be empowered to enact legislation to protect those communities from harm, and to exceed national norms for environmental protection. The Court has reserved judgment.
